Terms and Policies
You may schedule using our website tool, via the phone, via email, or via text message. When you schedule an appointment you consent to have your credit card on file charged for the deposit amount, or for the full cost of the appointment. On the day of your appointment you consent to have your credit card charged for the full balance of your appointment.
Deposits & Cancellation
We will collect a deposit to schedule an appointment. Clients may reschedule or cancel the appointment and receive a full refund up to 24 hours before the scheduled appointment time. If the appointment is cancelled or rescheduled with less than 24 hours before the scheduled time then the deposit is forfeited. In the case of a forfeited deposit the payment is used to offset the loss from the opportunity cost of the appointment time. The deposit is then non-refundable and can not be applied to future appointments.
When you schedule your first appointment we will collect a deposit and securely save your credit card to your file. When you schedule subsequent appointments we will charge your credit card on file for the deposit amount, or for the full amount if you choose. On the day of your appointment we will charge your card on file for any remaining balance of the appointment cost. If you want to use a different credit card for your appointment you must notify us and provide the updated card information before any charges are scheduled to be processed. Do not ever send your credit card information via email or any other insecure method.
Refunds & Reshoots
In the event that you are unhappy with any service performed we will make it right by either re-creating the media or offering a refund except for reasons stated in this agreement. It’s our discretion as to which remedy we offer. We will re-shoot or re-edit anything you are unhappy with, or we will offer you a refund for the services you are unhappy with, except for reasons stated in other sections of this agreement. When we issue a refund your license to use the media is terminated and you’ll need to immediately remove the media from any services or platforms it has been added to.
Appointment times & running late
ZipCasa’s online scheduling tool will give you estimated times for each appointment based upon the property’s size and the services booked. We require the full stated time to complete the services. If you are running late or the property is unavailable to shoot at the scheduled start time for any reason we may not be able to complete the scheduled services within the remaining time in your appointment. If we are unable to complete the services in the remaining allotted time in your appointment you will forfeit the services that we are unable to complete. In this instance we will prioritize basic listing photos first, and then any remaining services in an order you choose or at our discretion. If we are unable to begin at the stated time due to circumstances outside of our control you will not be entitled to a refund for any uncompleted services, and any follow-up visits to the property to complete the services will be billed as new appointments. If we are unable to start shooting due to our error we will complete the services at no additional expense to you, including revisiting the property at our own expense if necessary.
Properties photographed “as-is”
Properties must be cleaned and staged before our arrival. The property will be photographed exactly as it is upon our arrival. Anything that you don’t want to be in the photographs must be removed prior to our arrival. This includes clutter, laundry, medicines, vehicles, and anything else that may be present. It may be possible to remove these items in Photoshop after the fact. If it is possible, then the removal of any item from a photograph will cost $25 per photo. It some instances it is not possible to remove items in Photoshop. Items can not be removed from 3d tours or videos.
You assume responsibility for the safety of the photographer for the duration of the appointment. It is your responsibility to make sure that any residents on the property are aware of the appointment and will not pose any safety risk to the photographer. You must make sure that any animals are safely separated from any area the photographer is working in. You must address any and all potential risks to the safety of the photographer when they are photographing the property. If the photographer feels unsafe for any reason they have the right to terminate the appointment and you will not be entitled to a refund.
No people or pets
We love animals, and we love people, but they make our job tougher. There must be no contractors, workers, or residents present during the appointment. If the homeowner is present they must excuse themselves from any portion of the house being photographed. Pets should be put somewhere that won’t be photographed or they should be boarded for the day. If any contractors, gardeners, pool cleaners, or other people are present they will be included in the photos. It’s your responsibility to keep all people and animals out of frame, or they will be in the photographs. When possible, people or pets can be photoshopped out of a photograph at a cost of $25 per photo. They can not be removed from videos or 3d tours.
Delivery of files
We will deliver all Media within 2 business days of the completion of the appointment, unless otherwise stated. We will provide media in a format that is acceptable for upload to listing services. When possible, and when requested by you, we will upload images on your behalf to various listing services or media platforms.
3D tours have several limitations. The 3D camera will be visible in any reflective surface. We will do our best to keep ourselves out of all 3D images, but sometimes it is inevitable that the photographer will be visible in a reflective surface, or in rare instances the image itself. 3D tours will have visual artifacts and the appearance of glitches. This is a limitation of the technology. 3D tours will NOT include any outdoor spaces unless previously agreed upon. 3D tour technology does not work well with UV light, thus it doesn’t work properly outdoors in daylight. If any outdoor spaces are included they will appear to glitch when the view is changed. 3D tours will be hosted on ZipCasa’s enterprise Matterport account free of charge for 12 months, or for the duration of the listing, whichever is shorter. After 12 months if you wish to continue hosting for the Matterport 3d tour you will be charged $39 to renew hosting for another year.
We provide floor plans solely as a marketing tool. The measurements and calculated floor areas are an approximation. They are not representative of the actual or appraised square footage, and they should never be used for any purpose other than demonstrating the approximate layout of a property.
Whenever possible we will photograph properties during poor weather. If you do not wish to have the property photographed during poor weather you must cancel at least 24 hours prior to the shoot start as outlined in the cancellation policy. It’s your judgement call based upon any weather services you check. If you do not cancel the shoot 24 hours before we will still photograph the property, even if it is raining. If we are able to take still photographs, but not able to perform other services such as video or aerial images, you will be refunded the price of the additional services, or you may reschedule the services at a later date. In cases of extreme weather we may cancel the appointment at any time up to and during the time of the appointment. If we choose to cancel the appointment due to weather at any point we will reschedule at no additional cost to you.
Unmaned Aerial Vehicles (UAVs) are subject to both federal, state, county, and city regulations. We will only fly when it is legal and safe to do so. Many things can prevent a drone flight including, but not limited to: rain, fog, high winds, temporary or permanent FAA no-fly zones, controlled airspace restrictions, or any other reason a UAV pilot determines at the time of the planned flight. If we determine it is unsafe or not possible to fly a drone we will give you a full refund for the price of the drone add-on service.
Liability Release & Indemnification
You agree to indemnify and hold harmless ZipCasa and it’s employees, contractors, owners, officers, and agents against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of the services performed by ZipCasa or any other action.
In the event that ZipCasa breaches any terms of this agreement or causes any damages, material or otherwise, to any party or to the property, the maximum remedy will be equal to 100% of the price of services. Under no circumstances will ZipCasa be liable for an amount greater than 100% of the agreed upon service price.
Image use & copyright
ZipCasa maintains the copyright and ownership of all media. You, the Client, are granted an unlimited license to use the images for any purpose explicitly related to the marketing and sale of the property, and for no other use. Uploading images to any service or platform does not transfer your license or transfer ZipCasa’s copyright ownership under any circumstances. This license is valid for the entire duration of the property being listed for sale. When the property is delisted or sold the license expires. The license is exclusive to the original Client and is non-transferable. The license will be extended at no additional charge if the property is de-listed without a sale, and then re-listed by the same Client for the same property owner.
ZipCasa maintains the right to use the Media for any purpose including, but not limited to: display in our portfolio, website marketing, internet advertising, print advertising, or any other use. Clients may request a property be excluded from these uses and when possible we will do our best to accommodate, but we maintain the right to use any Media at our sole discretion.
We will update these terms from time to time without notice. It is your responsibility to be aware of the terms of this agreement and if they have changed. Every appointment scheduled now and in the future will be bound by these agreement terms. If one or more of the provisions contained in the Agreement is found to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not be affected. Such provisions shall be revised only to the extent necessary to make them enforceable.
Like most website operators, ZipCasa collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. ZipCasa's purpose in collecting non-personally identifying information is to better understand how ZipCasa's visitors use its website. From time to time, ZipCasa may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.
ZipCasa also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on https://zipcasa.com/ blog posts. ZipCasa only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.
Gathering of Personally-Identifying Information
Certain visitors to ZipCasa's websites choose to interact with ZipCasa in ways that require ZipCasa to gather personally-identifying information. The amount and type of information that ZipCasa gathers depends on the nature of the interaction. For example, we ask visitors who sign up for a blog at https://zipcasa.com/ to provide a username and email address.
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

ZipCasa discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on ZipCasa's behalf or to provide services available at ZipCasa's website, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using ZipCasa's website, you consent to the transfer of such information to them. ZipCasa will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, ZipCasa discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when ZipCasa believes in good faith that disclosure is reasonably necessary to protect the property or rights of ZipCasa, third parties or the public at large.
